1. Acceptance of Terms
Welcome to Golden Hour Studios! These Terms and Conditions ("Terms") govern your access to and use of the Golden Hour Studios website (the "Site"), our photography services (the "Services"), and any content provided by Golden Hour Studios ("Content"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Site or Services.
These Terms constitute a legally binding agreement between you and Golden Hour Studios, located at 42 Oak Street, Suite 200, Springfield, IL 62704. We may modify these Terms at any time without prior notice. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates. The last update date will be noted at the bottom of this page.
2. Services
Golden Hour Studios provides professional photography services, including but not limited to:
- Portrait Photography: Individual, family, and graduation portraits.
- Wedding Photography: Capturing your special day from ceremony to reception.
- Event Photography: Documenting corporate events, parties, and celebrations.
- Commercial Photography: Product, architectural, and promotional photography.
Service availability may vary and is subject to change without notice. We reserve the right to refuse service to anyone for any reason at any time. All bookings are subject to our availability and require a deposit to secure your session. Details regarding deposits and cancellation policies are outlined in our booking agreement, which will be provided upon inquiry.
Golden Hour Studios strives to deliver high-quality photographic services that meet or exceed client expectations. However, the final aesthetic and artistic interpretation remain at the discretion of the photographer, considering the style and vision of Golden Hour Studios. We encourage clients to discuss their preferences and vision with us during the consultation phase.
3. User Conduct
You agree to use the Site and Services in a responsible and lawful manner. You agree not to:
- Use the Site or Services for any illegal or unauthorized purpose.
- Interfere with or disrupt the Site or Services or servers or networks connected to the Site or Services.
- Attempt to gain unauthorized access to any portion of the Site or Services or any other systems or networks.
- Transmit any viruses, worms, or other malicious code.
- Collect or harvest any personally identifiable information from the Site or Services.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Engage in any conduct that restricts or inhibits any other person from using or enjoying the Site or Services.
Golden Hour Studios reserves the right to investigate and prosecute violations of any of the above terms to the fullest extent of the law.
4. Intellectual Property
All Content, including but not limited to photographs, images, text, graphics, logos, and software, is the property of Golden Hour Studios or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any Content without the express written consent of Golden Hour Studios.
Upon completion of your photography session and full payment for services, you will receive a limited license to use the final edited photographs for personal, non-commercial purposes. This license does not grant you the right to sell, modify, or commercially exploit the photographs without express written permission from Golden Hour Studios. Golden Hour Studios retains all copyright to the images.
Golden Hour Studios reserves the right to use the photographs for promotional purposes, including but not limited to website display, social media, and marketing materials. If you prefer that your photographs not be used for promotional purposes, please notify us in writing prior to your photography session.
5. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GOLDEN HOUR STUDIOS DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
While we strive to provide high-quality Services, we cannot guarantee specific results or outcomes. Factors such as weather conditions, subject cooperation, and event logistics can influence the final product. Golden Hour Studios is not responsible for any loss or damage resulting from circumstances beyond our control.
6. Limitation of Liability
IN NO EVENT SHALL GOLDEN HOUR STUDIOS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF GOLDEN HOUR STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO GOLDEN HOUR STUDIOS FOR THE SERVICES GIVING RISE TO THE CLAIM.
This limitation of liability applies to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Golden Hour Studios is not responsible for any damages, losses, or injuries incurred during a photography session caused by your own negligence or failure to follow our instructions. We strongly advise clients to exercise caution and prioritize safety during all photography sessions.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or relating to these Terms or the Site or Services shall be instituted exclusively in the state or federal courts located in Springfield, Illinois, and you consent to the jurisdiction of such courts.
Any cause of action or claim you may have arising out of or relating to these Terms or the Site or Services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
8. Miscellaneous
These Terms constitute the entire agreement between you and Golden Hour Studios relating to your use of the Site and Services. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Golden Hour Studios' failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign these Terms without the prior written consent of Golden Hour Studios. Golden Hour Studios may assign these Terms at any time without notice to you.
